Prosecutions September 2007

  • Mr K L Baker pleaded guilty to four charges, at Weston Super Mare Magistrates court, under The Trade Descriptions Act 1968 for making false claims of being CORGI registered. Two charges were brought against Mr Baker and another two charges brought against the business Atmosclear Ltd, with Mr Baker being the Director. Mr Baker was previously CORGI registered under the trading name K L Baker Services, CORGI registration number 18135, for the period 28/02/91 to 14/11/05 and the registration was withdrawn due to the company's work procedure. Mr Baker was fined £500 for each offence and ordered to pay costs of £1,649. The total fine of £3,649.
  • Mr Loi t/a L B London as he was falsely advertising his business as CORGI registered. Following their investigation Trading Standards decided that in this case a Formal Warning letter should be issued, advising Mr Loi that he should not falsely use any trade marks in future.

  • Mr Philip Goodman, a self-employed plumbing and heating engineer, previously of Glapwell, but now residing in Stockton on Tees, was fined £3,000 at Chesterfield Magistrates' Court for working on gas appliances without being CORGI registered. The Health & Safety Executive (HSE) prosecution came after the investigation of complaints relating to work Goodman had carried out at four separate addresses. At three of the four addresses, gas appliances that had been worked on by Mr Goodman were found to be "immediately dangerous" or "at risk". At one address he used a fictitious CORGI registration number on the gas safety certificate paperwork where he had "certified" the gas boiler as safe for continued use. A valid certificate was needed by the homeowner as she operates from the house as a registered childminder. The boiler was later found to be immediately dangerous. Goodman was fined £500 for each of the six offences and ordered to pay costs of £2,700.
